Pursuant to Article 69 of the Games of Chance Act (Official Gazette 87/09, 35/13, 158/13, 41/14, 143/14, 114/22 and 72/25) and the Ordinance on Organizing Prize Games (Official Gazette 125/25), the company MONTANA PLUS d.o.o., with its registered seat in Zagreb, Planinska ulica 15, Personal Identification Number (OIB) 27348336205, hereby adopts the following

RULES OF THE PRIZE GAME "MONTANICA, CAKE OR SWEET SANDWICH?"

(hereinafter: the Rules)

Article 1. Organizer

The organizer of the prize game is MONTANA PLUS d.o.o., with its registered seat in Zagreb, Planinska ulica 15, OIB: 27348336205 (hereinafter: the Organizer). All participants who enter the prize game accept these Rules, are familiar with them, and by entering the prize game fully agree with them.

Technical support in conducting the prize game and the SMS service Operator is New Level d.o.o., Ulica Huga Badalića 31, Zagreb, OIB 99200431992 (hereinafter: the Agency).

Article 2. Duration of the prize game

The prize game runs from 17 August 2026 at 00:00 to 20 September 2026 at 23:59, exclusively at Konzum points of sale throughout the Republic of Croatia.

Article 3. Purpose of the prize game

The prize game is organized and conducted for the purpose of promoting the Organizer and its business activity, as well as improving the sales and placement of the Organizer's products in Konzum stores.

Article 4. Right to participate in the prize game

Any adult natural person with permanent or registered temporary residence in the Republic of Croatia may participate in the prize game (hereinafter: participant).

Employees, owners, and management of the Organizer and its affiliated companies, of the Agency, as well as their immediate family members (spouse, common-law partner, parents, children, siblings, and persons legally equated with them), and other persons who in any way participate in organizing and conducting this prize game, may not participate in the prize game.

Each participant may participate in the prize game only in their own name, and by participating confirms that all personal data submitted is exclusively their own personal data and that they agree with the Rules and conditions of the prize game.

A condition for participation in the prize game is that participants are familiar with and agree to the Rules of the prize game.

Participation in the prize game (by sending an SMS message or filling out the web form and clicking to accept the participation terms) is considered to definitively bind the participant to these Rules, which is an irrevocable condition for participation in the prize game.

For the purpose of conducting this prize game and fulfilling the purpose for which it was organized in accordance with the Rules, the participant shall provide the Organizer with the following personal data: first and last name, home address, contact mobile phone number (hereinafter: mandatory personal data), while winners will additionally be asked to provide their OIB, an identification document for inspection, and, if necessary, other data required for the delivery and realization of the prize.

Article 5. Method of participating in the prize game

To participate in the prize game, it is necessary to make a one-time purchase of any one Montanica sweet sandwich at the points of sale referred to in Article 2. The receipt number must be submitted in one of the following ways:

  • By sending an SMS message with the content: MONTANICA, receipt number, first and last name, address (street, postal code and place) to number 60777. The price of the SMS message is €0.32, VAT included.

or

  • By filling out the web form at www.montanaplus.com

The original receipt, as proof of purchase, must be kept until the end of the prize game and presented upon the Organizer's request when claiming a prize. Each individual receipt may be used only once and submitted by sending an SMS message or filling out the web form. If a receipt with the same number is submitted again, whether by the same or another person, that entry will be declared invalid.

All participants who meet all the conditions of this prize game and who have acted in accordance with the steps described above will be included in the list for the electronic prize draw.

The length of an SMS message is limited to 160 characters, or 70 characters if diacritical marks are used (e.g. č, ć, š, ž, đ). A message whose length exceeds these limits will be split into another message and charged accordingly by the mobile operator. For this reason, it is recommended not to use special characters in the text of the SMS message.

Article 6. Prize fund

The prize fund consists of:

  • Main prize: 1x trip to the Legoland Germany theme park for two adults and two children, including travel costs, bed & breakfast accommodation (2 days) at the Feriendorf hotel and Legoland admission tickets, prize value €2,000.00
  • Weekly prize: 5x Montana refrigerator and 15 Montanica sweet sandwiches (5 Noko sandwiches, 5 Koko sandwiches, 5 Ruby sandwiches), prize value €300.00
  • Weekly prize: 40x Konzum gift voucher, prize value €50.00
  • Weekly prize: 35x Lego Birthday Party Cake set, prize value €16.00

The total value of the prize fund is €6,060.00 including VAT. The Organizer undertakes to pay 5% of the total value of the prize fund to the Croatian Red Cross.

If a prize winner does not want or is not able to accept the prize, or has not met the other conditions of the prize game and therefore does not acquire the right to the prize, the prize will be handled in accordance with the Ordinance on Organizing Prize Games (Official Gazette 125/25).

Photographs of all prizes in all promotional materials are symbolic and serve informational purposes only.

Neither the Organizer nor the winner of the main prize may financially upgrade or supplement the awarded prize (winner's additional payment).

Article 7. Prize draw and announcement of winners

The draw of weekly prize winners will be held according to the following schedule:

  • 24 August 2026 - for entries from 17 August to 23 August 2026 (16 winners)
  • 31 August 2026 - for entries from 24 August to 30 August 2026 (16 winners)
  • 7 September 2026 - for entries from 31 August to 6 September 2026 (16 winners)
  • 14 September 2026 - for entries from 7 September to 13 September 2026 (16 winners)
  • 21 September 2026 - for entries from 14 September to 20 September 2026 (16 winners)

At each weekly prize draw, winners will be drawn for:

  • 1x Montana refrigerator and 15 Montanica sweet sandwiches, prize value €300.00
  • 8x Konzum gift voucher, prize value €50.00
  • 7x Lego Birthday Party Cake set, prize value €16.00

The draw for the main prize winner will be held on 21 September 2026 for all entries from 17 August to 20 September 2026.

Prize draws will be held on the Organizer's premises in the presence of a three-member commission. Winners will be drawn using a computer application, by a method of random selection, using a certified random number generator in accordance with the Ordinance on Organizing Prize Games (Official Gazette 125/25).

One person may win only one prize of the same type and only one prize per draw.

The commission will verify whether the winner participated in the prize game in accordance with these Rules.

Minutes shall be kept of the course of the draw, which must contain: the place and time of the draw, the class and file number, the date of approval of the prize game, the date and name of the electronic or other public medium in which the rules were published, the names and addresses of the commission members, the method of drawing winners, the name and address of the winner, and the name and value of the prize for each winner. The minutes shall be signed by all members of the commission, and the Organizer shall submit the signed minutes to the Ministry of Finance within 8 days of the date the prize winners are drawn.

The first name, last name, and place of residence of all winners will be published within 8 days of the draw on the website www.montanaplus.com.

Any part of the prize fund with a value greater than €663.61 that remains undistributed after the end of the prize game will be sold by the Organizer at a public sale, and the proceeds from the sale will be paid into the state budget within 90 days of the expiry of the deadline for claiming prizes.

If fewer participants enter the prize game than the number of prizes provided for in the prize fund, the draw will continue so that the same participant may be drawn more than once, until winners have been drawn for all prizes.

Article 8. Claiming prizes

The prize cannot be exchanged for money. Upon receipt of the prize, all further obligations of the Organizer toward the winner cease. Winners will be notified of their win and the method of claiming the prize within 8 days of the draw. Prizes will be sent to winners by post or courier delivery. Prize winners must claim their prize within 30 days of the date they receive notification of the prize won.

If winners do not claim the prize within that period, they will be notified again and will be able to claim the prize within 15 days of receiving the additional notification. If a winner is not able to personally collect their prize, it may be collected by a person authorized by the winner.

Within eight days after the expiry of the deadline for claiming prizes, the Organizer will submit to the Ministry of Finance data on the winners of prizes worth more than €1,000.00, the name and value of the prize, proof of receipt of the prize, and a list of any unclaimed prizes.

Article 9. Other provisions

The Organizer is not liable for incomplete, incorrect, or late entries. The Organizer and the persons participating in conducting the prize game are not liable for any damage that might arise from the prizes or benefits.

The prize game may be interrupted only if circumstances arise for which the Organizer is not responsible and which it could not prevent, remove, or avoid. Participants will be notified of the interruption of the prize game on the website www.montanaplus.com. In that case, the Organizer is not liable to participants for any resulting damage. The Organizer's decision on all matters related to the prize game, i.e. the application of these rules, is final and binding on all participants.

Article 10. Publication of the rules

The Rules of the prize game, stating the class, file number, and date of issuance of the Ministry of Finance's approval, will be published on the website www.montanaplus.com before the start of the prize game.

Article 11. Disqualification of participants

The Organizer will disqualify a participant if it determines that the participant has provided untrue, false, or someone else's personal data, or if there is suspicion of abuse of the prize game. Any attempt at manipulation or fraud during entry will in particular be considered abuse of the prize game, and the Organizer will disqualify and prevent further participation in this prize game by participants found engaging in such conduct.

Article 12. Termination of obligations

At the moment the prize is claimed, or, if necessary, upon signing a special agreement or statement of receipt of the prize, all obligations of the Organizer toward the winner cease. The Organizer bears no responsibility or costs whatsoever arising for the winner from the handover of the prize or after the handover of the prize.

The Organizer assumes no responsibility for:

  • any accidents or injuries arising from the use and/or enjoyment of the awarded prizes, to which winners expressly agree;
  • any consequences arising from incorrect use or abuse of the conditions of the prize game by participants or third parties;
  • undesirable consequences suffered by participants as a result of participating in the prize game;
  • the (in)accuracy and (lack of) up-to-dateness of data submitted by participants in the prize game;
  • personal data that a participant makes available to other participants or to third parties in any way, and for the use of such submitted data by other participants or third parties;
  • circumstances and situations for which the Organizer's liability is excluded under these rules, or for which the liability of the participant or winner is defined;
  • the improper functioning of the Internet, the (non-)functioning of email, telephone lines, or other devices enabling the conduct of this prize game. The Organizer is also not responsible if one or more participants, for any reason or due to technical error, are unable to participate in the prize game;
  • any damage caused to a participant, their computer equipment, smartphone, or data stored on those devices, nor for any personal or professional consequences that may result for participants from that.

Article 13. Processing of personal data

By participating in this prize game, participants agree and give their consent that, should they become prize winners, the Organizer may, free of charge, use and publicly disclose their personal data (first and last name, place of residence) in printed, audio, image, and video material, for the purpose of publicly announcing the results of the prize game, both when announcing winners and awarding prizes, and in the publication of reports, articles, or similar materials related to the prize game.

The Organizer, as the controller of the collection of personal data of participants and winners, collects, keeps, maintains, and processes the collection of gathered personal data exclusively for the purpose of conducting the prize game, in accordance with these Rules.

When entering the prize game, upon a specific request from the Organizer, the participant may, through an active affirmative action, if they wish, give their consent for the use of the mandatory personal data for other purposes as well (e.g. for automated processing of personal data and a personalized approach to the participant, use by companies affiliated with the Organizer, etc.), and may, if they wish, provide other additional personal data for use and processing for the specifically stated purposes and others.

A participant may withdraw such consent at any time by sending a request to the email address or registered office address of the Organizer, according to the contact details provided on the Organizer's website.

The Organizer uses and processes personal data submitted exclusively by the participant, and the participant is solely responsible for the accuracy and correctness of the data provided and is obliged and responsible for informing the Organizer of any changes to that data in a timely manner.

The participant has the right, at any time, to request information about their personal data processed by the Organizer, and may also lodge an objection to the use of their personal data in situations where the Organizer relies on its legitimate interest, and in any case when the Organizer uses the data for direct marketing purposes.

To exercise all their rights and obligations regarding the use of personal data, a participant may contact the Organizer's email address or registered office address, or follow the instructions provided in the promotional materials.

All personal data will be protected through the application of appropriate organizational and technical measures, and will be handled lawfully and fairly in accordance with applicable personal data protection regulations.

The participant is informed of, and agrees to, the possibility that the Organizer may carry out certain personal data processing activities through a data processor within or outside the EU (a natural or legal person that processes personal data on behalf of the data controller). In doing so, the Organizer will carry out the transfer lawfully and select a data processor that meets all appropriate security standards guaranteeing a high level of protection of personal data.

The participant is aware of and expressly agrees that the Organizer may entrust individual tasks related to the processing of personal data obtained to the Organizer's contractual partner, the Agency, which may process personal data only within the scope of the authorization or instructions received from the Organizer, in accordance with applicable legislation and for the purpose of conducting the prize game, in accordance with these Rules. Personal data will be used and stored until withdrawn by the participant, in accordance with the Rules, unless otherwise prescribed by law.

Winners are aware of and expressly agree that the winners' personal data may be shared with the Agency as the Organizer's contractual partner, solely for the purpose of conducting this prize game.

Winners' personal data may be shared with a postal service or courier delivery service provider for the purpose of delivering prizes.

The Organizer will take all reasonably necessary measures to ensure that the personal data of participants in the prize game is processed and used in a secure manner and in accordance with applicable legislation.

Article 14. Complaint resolution and validity of the rules

All complaints and objections are resolved by the Organizer. In the event of justified complaints, the Organizer undertakes to correct the deficiencies as soon as possible and to notify the participant, or if necessary, other participants, accordingly.

In the event of a dispute between the Organizer and a participant in this prize game, the Zagreb Municipal Civil Court shall have jurisdiction.

Article 15. Final provisions

A participant who takes part in the prize game accepts the rights and obligations arising from these Rules, and by entering confirms that they are informed of the purpose for which their personal data will be used and handled.

The Rules take effect once the Ministry of Finance gives its approval and they are made publicly available.

The Organizer reserves the right to amend the Rules of the prize game if required by legal, technical, or commercial reasons. The Organizer will notify participants of any amendments by publishing them on the website www.montanaplus.com. In such cases, the Organizer is not liable for any resulting damage to participants in the prize game.

The authentic interpretation of the Rules is determined exclusively by the Organizer.
